Thailand Exhibition User Privacy Notice

Future Mart Creation Company Limited (the “Company”) would like to inform the user of Thailand Exhibition platform of the conditions and necessity that the Company would need to process the personal data of the relevant user (the “User”). Once any User register the User account in order to use the event marketing tools in the following hyperlink: https://www.thailandexhibition.com/ (the “Platform”), the Company shall deem that you accept and agree to this Privacy Notice.

Please study this Privacy Notice together with the terms of services for the use of the Platform disclosed an announced by the Company in details. In case any User does not accept this Privacy notice, the Company reserves the right to reject providing services to the relevant User since the process of these personal data as defined hereunder is critical for the performance of the Company’s obligations to provide relevant services to the User.

This Privacy Notice is only applicable to the User of the defined Platform and/or any User that contact the Company in any circumstances, including for the use of any other services. Yet, this Privacy Notice shall not be applicable to the service or other platform of the third party that may connect to the Platform. It should be noted that the Company would not have any control over those third-party platform and service; therefore, the User would need to study the separate privacy notice as may be announced by the relevant third party service provider.

The Company may make any adjustment or amendment to this Privacy Notice from time to time in order to assure the compliance with the relevant laws and the adjustment made to the scope of Service provided to the User; provided that the adjusted Privacy Notice shall be communicated to the User through the communication channels.

Personal Data being Processed for the Services Performance by the Company to the User

Processing of the following personal data as defined hereunder is critical for the performance of services by the Company to the relevant User:

1. Direct personal data, including full name, contact information, identification card number and the User’s interest in event hosing that the User shall provide during the User registration process; provided that it is understood that the personal data provided at this stage may include the personal data of each User or of the User’s representative (in case of the corporate User). In case the User provide the personal data of the User’s representative to the Company, the Company shall deem that the relevant User has the legitimate rights to disclose those personal data to the Company;

2. User’s Platform usage information, including transaction logs, communication information that the User may have with the Company; the user ID, password, transaction history log; and other technical information that can identify the relevant User, including IP Address, browser network and configuration of the devices used to connect to the Platform; as well as certain types of cookies that will be used to track the User’s behavior on the Platform;

3. Payment information that evidences the payment made by the relevant User to the Company, including bank account information or credit card information used for the User registration;

4. Information that the User may give to the Company, including the User’s interest and preference to enable the matching function and in order for the Company to make relevant suggestion of the event or venue that may be of the User’s interest; and

5. Other personal data that the User may give to the Company during the communication for the service performance or other personal data that the User may give consent to the Company to process.

Purpose for the Process of the defined Personal Data

The Company may collect, use and process the defined personal data for the following purposes:

1. To verify the qualification of the relevant User before the permission to access the Platform and to use the relevant services from the Company be granted; provided that the qualification shall be verified pursuant to the terms and conditions defined in the terms of services; and to verify the transaction and communication made between the Company and the relevant User;

2. To contact the relevant User for the purpose that the Company will be providing the supporting services to the Company that may include to present and suggest the event or the venue that the Company may have in the database that would match the interest and qualifications that the relevant User has set and registered;

3. To build and improve the business relationship that the Company may have with the relevant User, including for the internal control, the employee training or quality control to be implemented and undertaken by the Company as well as for the analysis and management of any complaint or problem faced by any User;

4. To manage and respond to any query or contact that the Company may have with the relevant User (i.e. to address certain queries made or manage complaints or feedback made)

5. To analyze the User’s interest for the future improvement of the Company’s services, in particular the use of those personal data in the internal design and test to assure that all the services to be provided would match the User’s interest and preference with an aim to improve the business relationship between the Company and the relevant User;

6. To prevent and check for any fraud or any violation of any terms and conditions applicable to the user and to assess; to manage the business risk of the Company; and to protect the legitimate interest and rights that the Company may have against the relevant User even after the termination of the relevant service agreement between the Company and the User; and

7. To performance of legal obligations that the Company may have, including in particular, the tax and accounting laws, and the legal obligations under the Computer Crime or Electronic Transaction under which the Company would need to retain the collected personal data for the period of time prescribed under the applicable laws.

To the fullest extent and period permitted under the relevant laws, the Company would like to inform the User of the necessity that the Company has in processing and retaining the User’s personal data for the defined purposed for so long as the User remains the user of the Company and for the period of 1 year after the termination of the user service agreement that the Company would like to reserve the right to retain the User’s personal data in order to facilitate the User resumption thereafter. In addition, the Company would need to retain the User’s personal data as necessary for another 3 years for the purpose of protecting the legitimate rights and interest of the Company against the relevant User, in particular in the fraud or violation cases.

Disclosure of the Personal Data

Generally, the personal data of the Customer’s Representative will be kept confidential; provided that in certain circumstances the personal data of the Customer’s Representative may need to be disclosed to the following persons in order for the Company’s performance of the contractual and legal obligations: (i) to the third party service provider of the Company, in particular the logistic and delivery service providers; (ii) to the legal counsel or litigator in case that the Company would need protect their legitimate rights in any dispute or claim raised; and (iii) to the government authorities that the Company may be obliged under the relevant laws to disclose the personal data to those authorities; provided that in all of these circumstances, the Company will only disclose the personal data to the necessary extent to perform those obligations or to serve the defined objectives.

1. To other User on the same Platform for the purpose of the coordination and contact between the parties in order to host the relevant event; provided that in case that any User obtains or receives any personal data of any person, such User shall respect the data subject’s rights of the other User and shall not process those personal data without legitimate basis and shall not cause any defamatory damages to other data subject. In case of any damages incurred, the relevant User shall indemnify and hold the Company harmless from all those damages;

2. To any third-party service providers that has been engaged by the Company to assist in the performance of any services to the User, including without limitation the counsel or logistic service provider, marketing and event organizer; provided that the Company will only disclose the User’s personal data on the need-to-know basis pursuant to the terms and conditions of the data processing agreement to be entered into between the Company and such parties;

3. In order to protect the legitimate rights and interest of the Company or to prevent the fraud or any potential violation of any terms of use that may cause damage to the Company or other third party, the Company may need to disclose the User’s personal data to the legal counsel or litigator of the Company; provided that the Company undertakes to only disclose the User’s personal data on the need-to-know basis;

4. In order to perform the legal obligations under the relevant laws or the government authorities, the Company may need to disclose the User’s personal data to the competent authorities; provided that the Company would only disclose the data that are necessary for the performance of such obligations; and

5. To other persons that the User may give explicit consent to the Company to disclose their personal data to. Representation on the Information Security of the Personal Data The Company represent to implement the reasonable and appropriate information security measures of all personal data being processed in order to prevent the unauthorized access, amendment or disclosure of those information, in particular through the establishment of the internal mechanism to control the user management and authorization matrix with an aim to protect the confidentiality and security of the personal data; provided that the Company commits to review those measures from time to time to ensure the compliance with the relevant industry practice and relevant legal framework.

Data Subject Rights

The Company respect the User’s statutory rights as the data subject under the relevant laws over the relevant User’s personal data, including in particular the following rights: (1) the right to request for access or copy of their personal data as well as the right to revise or rectify the personal data; (2) the right to request for data portability; (3) the right to object to any process of their personal data; (4) the right to request for deletion or de-identification of the Client’s personal data once there is no further necessity; (5) the right to request for the suspension of the Client’s personal data processing; or (6) the right to withdraw consent. In case the Client would like to exercise any of these rights, please feel free to contact the Company as the defined contact channel and the Company will consider and get back to the relevant Client’s request within 30 days after the receipt of the Client’s due request.
